I have been in touch with a gay couple trying to go through the adoption process in Virginia. They have run into many issues and have learned that Virginia does not permit children to be adopted by unmarried couples, gay or straight.

The good thing is that most of the agency employees they have spoken with agree that a gay family is a great option for a placement, but their hands are tied by state laws. There are a handful of agencies who will work with gay couples by moving forward with a single parent adoption to one of the individuals and stating that the other is an unrelated adult in the home. In this case, the home study questions will look just a bit different.

Here's another way you can proceed in Virginia if you'd like to go the inexpensive route of adopting through a social services agency: Get your home study completed by the county you live in. If you're county will not complete a home study for your family because you are gay, you will have to pay a gay-friendly agency such as Friends in Adoption to complete your home study.

Once you have an approved home study, seek to adopt in a nearby state. Maryland, for example, has set a precedent to allow adoption by gay couples. There are agencies in and around DC that will work with you.
