Gay Adoption Laws by State
Gay adoption laws vary from state to state. Most states do not allow gay couples to adopt children, but they do allow single people who are gay to adopt (makes a lot of sense, huh-). But there are ways around this. See "Second Parent Adoption" link to the left. Some states are beginning to change laws to allow committed gay couples to legally adopt; however, most commonly couples must designate one person to complete the initial adoption and then pay all the legal fees and court costs associated with completing the second parent adoption.
Petition to Adopt
In order to complete your gay adoption, you must petition the court to adopt the child. Your adoption agency, social services agency, or lawyer will help you with, or in most cases, handle your petition for adoption. This will begin the court proceedings for your child's adoption. In most cases, states allow single people or married couples to petition the court to adopt a child. Some states have begun to allow unmarried couples, including same sex couples, to petition the court to adopt a child. Follow the links below to find the laws in your state.
